A dozen people in the migrant caravan making its way to the U.S. border have sued President Trump and others in his administration for threatening to stop them at the border and house them in tent cities.

The lawsuit, filed in the U.S. District Court for the District of Columbia by the following attorneys in Atlanta and Washington, DC, claims that Trump's position is " shockingly unconstitutional."

"President Trump continues to abuse the law, including constitutional rights, to deter Central Americans from exercising their lawful right to seek asylum in the United States, and the fact that innocent children are involved matters none to President Trump," it said.

The lawsuit also said Trump is violating the Fifth Amendment to the Constitution, which includes the due process clause that plaintiffs say applies to everyone in the U.S., including people seeking asylum once they arrive.

The lawsuit seeks immediate judgment for the plaintiffs and a declaration that Trump's border plan is unconstitutional.

 

A person with extraordinary legal knowledge here in New York City, who wishes to remain anonymous for professional reasons, told me:

"Atlanta and Washington DC being second rate cities, they have, as you might guess, second rate attorneys. 

 

Nowhere is that more evident than in this absurd court filing.   

 

Even the village idiot knows that these migrants are not U.S. Citizens, are not physically located in the United States and are not in US custody, therefore they have no Constitutional Rights. 

 

The village idiot understands that, but these second rate lawyers apparently don't get it."

 

Litigants in the case are listed as Maria Doris Pineda, Jasmine Ortega Sanchez, Francisco Javier Castillos, Holivia Adeline Castillos, Dina Ruc and Marta Lopez. Each of them are also listed as people filing the suit on behalf of their minor children, who aren't named.  None of the Plaintiffs list any address.

On the streets here in Manhattan this morning, members of the general public - none of whom are attorneys - took great umbrage to this effort.

When told of this lawsuit, Donald Krebbs a resident of Manhattan asked "Why would American lawyers try to help people invade our country?  Isn't that what a Domestic Enemy would do?"

Rene Sorentino of the Bronx said "The last thing we need is more people coming here who refuse to learn our language and come here just to get on welfare.  Keep them out!"

During a press conference yesterday in the White House, President Trump made an interesting point regarding the alleged claim for "Asylum" to be raised by these so-called "migrants."  The President said "Asylum is when a person seeks protection"  but these migrants were all offered permission to remain in Mexico by the Mexican government, which achieves protection from whatever they're claiming was  going on in their home country.  They were also offered housing, food, jobs, and health care, but THEY DECLINED Mexico's offer!  

Other speakers have pointed out that Asylum claims involve issues of abuse over race, religion, certain sexuality and other limited issues.  Said one person "Seeking a job cannot be the basis for an asylum claim."

    What is the quality in a legal action of ANY foreign national outside the juridiction of the USA?
    The invaders cannot pretend thaat the US laws to be for them and the courts cannot waste the US citizens money for things in no way connected to the USA territory and jurisdiction.

    The United States is obliged to recognize valid claims for asylum under the 1951 Convention Relating to the Status of Refugees and its 1967 Protocol. As defined by these agreements, a refugee is a person who is outside his or her country of nationality (or place of habitual residence if stateless) who, owing to a fear of persecution on account of a protected ground, is unable or unwilling to avail himself of the protection of the state. Protected grounds include race, nationality, religion, political opinion and membership of a particular social group. The signatories to these agreements are further obliged not to return or "refoul" refugees to the place where they would face persecution.

    If anyone of the caravan (which is currently two travel months away from the border, so the whole Army at the border thing is nothing but election campaign noise and will end right after the mid-terms) is surrendering themselves to an US-Border patrol and asking for political asylum, it would be unlawful to not let them enter, register them as asylum seekers, bring them into a refuge camp and get their paperwork processed.

    Any suggestions to shoot them like ducks while they are still on the Mexican site shows the kind of spirit that the Nazis proudly copied from you in the 1933-1945 period.

      WRONG! Under international law, all persons seeking political asylum MUST seek it in the first country they enter after leaving their own country...Mexico offered ALL of these people amnesty/asylum and many of them turned Mexico down...Hence under International law, they are NOT eligible to seek or be granted asylum in the USA!

        Wrong, too. They must seek it in the first SAFE country they enter.
        But anyway, even if they have made a mistake and Mexico for one reason or another can be considered a safe country, that would be good on you because that shortens up the paperwork your border judges will have to do. But they can't avoid the paperwork by putting the army there. The army is very restricted by law in what they are allowed within the US borders. And they cannot cause a Massaker on Mexican soil by shoting them down. what else ca they do? Best of al they cann tell the caravan people they can't cross the border here, they have to go to the next checkpoint. Who pays the military expenses for this stunt? You pay for it.

    Although I disagree with their "action", we do have a problem and they do have certain rights "if they are within our borders". Here are some reference items:

Both qualifying for the most likely to be a dumb ass award. And the two sleazebags above them. Well a picture does say a thousand words now doesn't it. I guess they missed that whole national emergency declaration huh? Pretty sure that takes the judiciary out of the game. Idiots.

    And this, folks, is what we can probably expect from here on out in the Trump administration ... opposition and the impossibility to what needs to be done to save America. Taint gonna happen. By design, taint gonna happen. I think Trump is just an NWO puppet playing his part in the theatre show. There's no way he is not a part of the show.       Unfortunately I am a Trump supporter because I have working intel on him from the past 20 years, inside he is good people, howver this multidimensional chess game he is playing is a little bit off, i did not support the cruise missle launches in Syria, did not support the Russian foreign policy diplomacy, did not support the lack of condemnation of the Russian logistical plane over Syria, did not support the possible use of neutron baby nukes on Syria by other foreign players, did not support the use of armed insurgents to topple duly elected officials in Syria. The only reason I support him is because I truly believe he is not whole with foreign policy structure, can be reformed, and internally has good character traits. The use of critical thinking and diplomacy is paramount to governing and leading by example but not at the expense of women and children and those without the ability to defend.

    So this is going to be another Jill Stein Recount Scandal where these lawyers setup a Go Fund Me page to fight Trump, collect millions and then forget about Going after Trump. Just like Jill Stein collected several million dollars to 're-count' the Trump vote, and very little went to that and the rest was purportedly embezzled elsewhere. The LEFT will cannibalize whats LEFT.
